AGREEMENT TO OUR LEGAL TERMS

We are First Officer Bot by Isaac Hernan ("Company", "we", "us", or "our").

We operate the website https://takeoff.piscinadeentropia.es , the First Officer Bot Telegram bot, the First Officer Bot Discord application/bot, and any other related products and services that refer or link to these Terms of Service (collectively, the "Services").

By accessing or using any of the Services, you agree to be bound by these Terms of Service. If you do not agree with these Terms, you must not access or use the Services.

1. OUR SERVICES

First Officer Bot provides aviation-related tools and information, including calculations, flight data, NOTAMs, METARs and other utility functions.

The Services are provided through different platforms, including Telegram and Discord. The Telegram and Discord versions operate through separate backend systems, although their data may be stored within the same underlying virtual storage infrastructure in separate platform-specific directories.

The information provided through the Services is intended for informational and utility purposes only and must not be considered professional aeronautical, operational, legal, meteorological or safety advice.

You are responsible for independently verifying any information before relying on it for an actual flight, operation or other safety-critical activity.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Services, including their source code, software, design, interfaces, logos, graphics, text, databases, features and functionality, are owned by or licensed to First Officer Bot by Isaac Hernan and are protected by applicable intellectual property laws.

You may use the Services only for their intended purpose and in accordance with these Terms.

You may not reproduce, modify, distribute, sell, sublicense, reverse engineer or otherwise exploit any part of the Services without prior authorization, except where such activity is expressly permitted by applicable law.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

• You have the legal capacity to agree to these Terms.
• You will comply with applicable laws and regulations.
• You will comply with the rules and policies of Telegram and Discord.
• You will not use the Services for unlawful purposes.
• You will not attempt to compromise or disrupt the Services.

4. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which they are made available.

You agree not to:

• Use the Services to conduct or facilitate unlawful activities.
• Attempt to gain unauthorized access to any Telegram or Discord backend, server, account, storage location, API credential, database or infrastructure.
• Attempt to bypass authentication, authorization, rate limits, security controls or other technical restrictions.
• Perform denial-of-service attacks, flooding, spam or other activities intended to degrade the availability of the Services.
• Use botnets, self-bots, automated user accounts or other unauthorized automation to interact with the Services.
• Reverse engineer, decompile, disassemble or attempt to extract source code or proprietary logic from the Services, except where expressly permitted by applicable law.
• Probe, scan or test the vulnerability of the Services or their infrastructure without prior authorization.
• Attempt to access data belonging to other users.
• Use the Services to distribute malware, malicious code or harmful content.
• Abuse commands or functionality in a manner that could negatively affect other users or the availability of the Services.
• Use the Services as a substitute for a qualified aviation professional, dispatcher, instructor, air traffic service, official aviation authority or other professional source.
• Use information obtained from the Services as the sole source for actual flight operations or safety-critical decisions.
• Redistribute or commercially exploit information obtained through the Services without our prior authorization.
• Circumvent any restriction imposed on your use of the Services.

5. USER-GENERATED CONTENT

When you submit commands, messages, requests or other content to the Services, you remain responsible for that content.

You grant us only the rights reasonably necessary to process such content for the purpose of providing and operating the requested functionality.

We do not claim ownership of content that you submit merely because you interact with the Services.

6. THIRD-PARTY SERVICES

The Services may interact with or depend on third-party platforms, APIs, data providers and infrastructure, including Telegram and Discord.

Third-party services are governed by their own terms, policies and availability. We do not control third-party platforms and cannot guarantee their availability, accuracy or continued operation.

In particular, your use of the Discord version of First Officer Bot is also subject to Discord's applicable Terms of Service and policies.

7. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to monitor, manage, modify, restrict or discontinue any part of the Services.

We may take reasonable action against users who violate these Terms, including limiting functionality, removing access, blocking accounts or identifiers, or removing the bot from a Telegram or Discord environment.

We may manage the Telegram and Discord versions independently. A restriction or termination on one platform does not necessarily imply a restriction or termination on the other platform.

By using the Services, you acknowledge the processing described in our Privacy Policy.

9. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to modify, suspend or discontinue any part of the Services at any time, including individual commands, features, integrations or platform versions.

The Services may occasionally be unavailable due to maintenance, technical problems, infrastructure failures, third-party outages, API limitations or other circumstances beyond our reasonable control.

We do not guarantee that the Services will always be available, uninterrupted, secure or error-free.

10. TERM AND TERMINATION

These Terms remain applicable while you use the Services.

We may terminate or restrict your access to the Services at any time where reasonably necessary, including where you violate these Terms or misuse the Services.

You may stop using the Services at any time by removing the bot, leaving the relevant environment or otherwise discontinuing your use of the Services.

11. DISCLAIMERS

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

We make no warranty that information provided by the Services is complete, accurate, current, suitable for a particular purpose or free from errors.

Aviation information may change rapidly. NOTAMs, METARs, weather information, flight data, calculations and other information obtained through the Services may be delayed, incomplete or inaccurate.

You must always consult authoritative and current sources before making aviation or safety-critical decisions.

12. LIMITATIONS OF LIABILITY

To the maximum extent permitted by applicable law, First Officer Bot by Isaac Hernan shall not be liable for indirect, incidental, consequential or special damages arising from or related to your use of the Services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

13. INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses, claims or expenses arising from your unlawful use of the Services, your violation of these Terms, or your violation of applicable third-party platform rules.

14. GOVERNING LAW

These Terms are governed by and interpreted in accordance with the laws of Spain, without prejudice to any mandatory consumer protection provisions that may apply.

Subject to applicable mandatory law, the parties agree to submit to the non-exclusive jurisdiction of the courts of Madrid, Spain.
